301.7   CONVERSION OF SEASONAL RESIDENCES

Before any seasonal residence is converted to a year-round residence the septic system must be inspected and approved to meet both town and N. H. Water Supply and Pollution Control Commission requirements existing at the time of the conversion. An occupancy permit will be issued only after such approval has been procured.

1301.7   SUPPLEMENTAL SUBSURFACE DISPOSAL SYSTEM REGULATIONS

B. Conversion of structure to full time use:

  1. Prior to obtaining an occupancy permit on a structure converted from seasonal use to year-round use, the subsurface disposal system approved for this conversion shall be installed.

 

RSA 155-D:8 Change of Occupancy.

Any change in the occupancy or use of any building or structure which would require an increase in demand for either fossil fuel or electrical energy supply, shall not be permitted unless such building or structure is made to comply with the requirements of this chapter (CHAPTER 155-D ENERGY CONSERVATION IN NEW BUILDING CONSTRUCTION)

RSA 485-A:38 Approval to Increase Load on a Sewage Disposal System.

  1. Prior to expanding any structure or occupying any existing structure on a full-time basis, which would increase the load on a sewage disposal system, the owner of such structure shall submit an application for approval of the sewage disposal system to the department. Application for approval shall include one of the following:
    1. Evidence that the existing sewage disposal system meets the requirements of the department for the intended usage or the town's minimum standards for use or occupancy prescribed under RSA 48-A:11, whichever is more stringent.
    2. The design for a new system which meets the requirements of the department for the intended use or the town's minimum standards for use or occupancy, whichever is more stringent.
  2. The fee for application under this section shall not exceed fees charged for new design applications.
  3. The commissioner shall adopt rules under RSA 541-A requiring a person to comply with the provisions of paragraph I before taking any action which would increase the load on a sewage disposal system.
